Pursuant to section 4.03 of the Indenture (the “Indenture”) dated December 22, 2020, among Empire Communities Corp (“Empire”), certain Subsidiary Guarantors, Bank of New York Mellon and BNY Trust Corp. of Canada, as Trustees, relating to Empire’s US$ 7.00% Senior Notes due 2025 and C$ 7.375% Senior Notes due 2025, Empire is required to provide access to financial reports and quarterly conference calls under certain conditions.
